Welcome to Online Driver Files. These Terms & Conditions ("Terms") govern your use of our website at onlinedriverfiles.com and our driver qualification compliance services. By using our website or purchasing our services, you agree to these Terms.

Online Driver Files is a service of K23 Futures LLC, a Pennsylvania limited liability company ("we," "us," or "our").

1. Services we provide

We produce compliance documentation for motor carriers regulated under the Federal Motor Carrier Safety Regulations, including:

  • Driver Qualification File (DQF) packets for CDL drivers under 49 CFR §391.51

  • Driver Qualification File (DQF) packets for non-CDL drivers under 49 CFR §391.51

  • Driver Investigation History File (DIHF) documentation under 49 CFR §391.53

  • Optional year-round expiration monitoring for licenses, medical certifications, and MVRs

Each packet is generated from carrier-provided driver information and delivered as a complete, organized set of documents with supporting guidance materials.

2. Pricing and payment

Standard pricing is published on our website. Founding Carrier pricing (50% off through August 31, 2026) is available to early customers. Pricing is per driver per packet. Payment is due before packet delivery unless otherwise agreed.

We accept payment via credit card and other methods specified at the time of invoice. Invoices are issued to the carrier (the contracting entity), not to individual drivers.

3. Carrier responsibilities

By engaging our services, the carrier agrees that:

  • The carrier remains the compliance officer of record for its operation

  • The carrier is responsible for the accuracy and completeness of all driver information provided to us

  • The carrier is responsible for executing, retaining, and producing compliance documents in response to any FMCSA audit or inquiry

  • The carrier is responsible for all FMCSA compliance obligations, including motor vehicle records, Clearinghouse queries, drug and alcohol testing, medical certification, and ongoing driver fitness for duty

  • The carrier is responsible for verifying state-specific obligations that may exceed federal minimums

We provide documentation tooling and templates. We are not the carrier's compliance officer, attorney, or representative.

4. Service scope and limitations

Our services include the generation of compliance documents based on carrier-provided information. Our services do not include:

  • Acting as a compliance officer of record for any carrier

  • Providing legal advice or legal representation

  • Conducting motor vehicle record searches, Clearinghouse queries, or background checks (unless explicitly included in an add-on service)

  • Performing actual driver investigations under §391.53 (we provide the file structure; the carrier conducts the investigations)

  • Responding to FMCSA audits or inquiries on the carrier's behalf

5. Currency of regulatory content

Our templates and citations reflect the Federal Motor Carrier Safety Regulations in effect as of the generation date of each packet. FMCSA rules change over time. The carrier is responsible for verifying ongoing regulatory accuracy and engaging our services for updated packets when material rule changes occur.

6. Disclaimer of warranties

Our services are provided "as is" and "as available." We make no warranty, express or implied, that any generated document will satisfy a specific FMCSA audit or inquiry. Use of our services is not a substitute for qualified legal or compliance counsel.

To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of liability

To the maximum extent permitted by law, our total liability to any customer for any claim arising from or related to our services shall not exceed the amount the customer paid us in the twelve months preceding the claim.

We are not liable for indirect, consequential, incidental, special, or punitive damages, including lost profits, lost data, or loss of business opportunity, even if we have been advised of the possibility of such damages.

8. Intellectual property

The contents of our website and the templates underlying our generated documents are the intellectual property of K23 Futures LLC. Customers receive a non-exclusive, non-transferable license to use generated documents for their own compliance and recordkeeping. Customers may not resell, redistribute, or sublicense our templates or generated documents.

9. Termination

Either party may terminate the service relationship at any time. Termination does not affect obligations or payments accrued before termination.

10. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Pennsylvania.

11. Changes to these Terms

We may update these Terms from time to time. The "last updated" date above will reflect the most recent change. Continued use of our services after changes constitutes acceptance of the updated Terms.
